Fitbit got sued in Australia for misleading consumers on faulty devices

Fitbit LLC has reportedly started legal actions for allegedly making false or deceptive statements to customers about their guarantee rights on defective products, according to the Australian Competition and Consumer Commission. Fitbit claimed that between May 2020 and February 2022, customers would not be entitled to a refund unless they returned a defective product within 45 days of purchase or shipment, which is against Australian Consumer Law, according to the Australian Competition and Consumer Commission (ACCC). In addition to any manufacturer warranties, all consumers have automatic consumer guarantee rights that cannot be renounced, reduced, or amended, according to ACCC Chair Gina Cass-Gottlieb. According to the regulator, Australian Consumer Law does not mandate a 45-day return term or tie consumer rights for faulty replacement items to the date of purchase.
